There's a major difference between being able to turn off 3D effects on a 3D system (which, by the way, isn't the case: the slider somehow reduces it to varying degrees but I'm not sure it "turns it off") False, you can turn the 3D off entirely. This has been confirmed repeatedly by Iwata and Reggie. In fact they strongly suggest young children and people who have issues with 3D turn it right off, especially considering the health consequences of looking at 3D images like these for too long are still unknown.

I don't mind not being able to turn off features so much as the idea that because you can use a feature, you feel compelled to do so even when it's not necessary. Case in point: G Generation Cross Drive. Okay, so it sucked in many ways having nothing to do with the touchscreen but since the previous game using the same engine managed to do fine with good old fashioned buttons, it was really annoying that the game made me drag and drop units and select commands via stylus. This was a turn-based game, it's not like I needed a stylus to control things quickly. I'd say something about RTS on the DS but I don't think anyone wants to remember... that.
Also, the two Zelda games. I admit that it's awesome how they made use of pretty much every gimmick the DS has but would it kill them to have added a button option for moving around and basic attacks, just in case you have people who don't want to have to hold the damned stylus constantly just to get Link to move around?
That being said, there are games where the stylus and/or touchscreen just works wonderfully so it's not that I don't like it. I just don't like it when the programmers decided to make use of them when there was no reason to.
And briefly returning to Ys on the 3DS. In the long term I wouldn't mind it but I'd rather they start with something simpler to get a feel for the system while building up a bit of a fanbase. Say, a remake of Dragon Slayer IV, which is sorely in need of more love. Not Ys or ED; Remember how pissy people everywhere got when Ys Seven was first announced as a PSP title? Sure it turned out great but Falcom already knew how to work with the system. I'd rather they ease into the 3DS in a similar fashion. Either port something or remake something that isn't a flagship series, just in case the first effort doesn't turn out so well.

I personally haven't been sold on the 3DS. I haven't seen it in action yet, and from the gigantic list of launch titles, the only game that interests me is Professor Layton and the Mask of Miracle, but only because I'm a massive Layton fan.
